In 2010, Congress passed The Dodd–Frank Wall Street Reform and Consumer Protection Act (Pub.L. 111-203, H.R. 4173) (the “Act”) which directs the Securities and Exchange Commission to issue rules requiring certain companies to disclose their use of conflict minerals if those minerals are “necessary to the functionality or production of a product” manufactured by those companies. Under the Act, those minerals include tantalum, tin, gold or tungsten (collectively referred to as “3TG”).
Congress enacted Section 1502 of the Act because of concerns that the exploitation and trade of conflict minerals by armed groups is helping to finance conflict in the Democratic Republic of the Congo (“DRC”) region and is contributing to an emergency humanitarian crisis. Companies must assess their supply chains and publicly report on the source of those materials if they are sourced from regions of conflict in and around the DRC. Although Sika Corporation (“Sika”) is not a publicly traded company and therefore not directly subject to this law, Sika recognizes that some of its downstream customers may be subject to such reporting requirements and will support those customers in meeting their obligations.
Sika has decided to use the reporting template created by the Electronics Industry CitizensCoalition® (EICC) and the Global e-Sustainability Initiative (GeSI) which can be found on the following pages. This reporting template is included in and made a part of this Declaration.
Sika does not directly source materials from the DRC region. Sika is in the process of conducting reasonable country of origin inquiries with our suppliers of 3TG to determine that their 3TG metals are not originally sourced from the DRC region.
